Purchase Options Cancellation Policy

PLEASE READ THIS POLICY CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND LIMITS CLUSTER'S LIABILITY TO YOU. BY PLACING AN ORDER THROUGH THE SERVICES, YOU AGREE TO THE TERMS BELOW.
Some items available through Cluster's Services may be offered as a subscription, a pre-order, or a try-before-you-buy purchase. This Policy explains how each of these purchase options works and how you can change or cancel them. It should be read together with Cluster's Returns & Refunds Policy and Shipping Policy.
As with all purchases facilitated through the Services, these purchase options are offered by the applicable Supplier. Cluster is not the seller, manufacturer, importer of record, or owner of any product, and only supports payment processing (via Shopify and/or Stripe), account management, and communication between the buyer and Supplier. Fulfillment, inventory availability, and product condition remain the Supplier's sole responsibility.
1. Subscriptions
When you purchase a subscription, you will receive repeat deliveries based on the duration and frequency you select at checkout.
- Payment. Your payment details are stored securely by Shopify and/or Stripe, and you will be charged for each delivery as it is processed, unless you choose to pay in advance. Cluster does not store your full payment card details.
- Auto-renewal. Some subscriptions may automatically renew at the end of their stated duration unless cancelled beforehand. It is the buyer's responsibility to track renewal dates and cancel in advance if renewal is not wanted.
- Cancelling or changing a subscription. You may cancel or change a subscription at any time before the next scheduled charge. Your order confirmation email contains a link to manage your subscription, or you may contact support@theclusterhub.com. Cancellation takes effect for the next unshipped delivery only — it does not reverse a charge already processed for a delivery that has shipped or is in progress.
- No retroactive refunds for past deliveries. Cancelling a subscription does not entitle the buyer to a refund for deliveries already fulfilled. See Cluster's Returns & Refunds Policy for how returns and refunds on delivered products are handled.
- Supplier discontinuation. If a Supplier discontinues a subscribed product or is removed from the Services, Cluster will use reasonable efforts to notify affected buyers, but is not liable for any resulting interruption, and any refund for undelivered, pre-paid installments will be handled per Section 4 (Pre-Orders) principles or the Supplier's own policy, at the Supplier's discretion.
2. Pre-Orders
When you purchase a pre-order, you are buying a product that is out of stock or not yet available in the Supplier's inventory, typically due to production, shipping, or customs timelines from India.
- Payment collected. Cluster or the Supplier may collect no payment, a partial deposit, or full payment at checkout. Where a deposit or partial payment is collected, your payment method will be securely stored and charged for the remaining balance when the order is ready to fulfill.
- Cancelling a pre-order. You may cancel a pre-order at any time before it has been fulfilled or shipped by the Supplier, and any deposit or partial payment collected will be refunded in accordance with Cluster's Returns & Refunds Policy. Once a pre-order has been fulfilled or shipped, it can no longer be cancelled — at that point, it is treated as a completed order, and any request for a refund is handled under the Returns & Refunds Policy, not this Section.
- No guaranteed fulfillment date. Pre-order timelines are estimates only, provided by the Supplier, and are not guaranteed by Cluster. Extended delays due to production, customs, or shipping issues in India do not, by themselves, entitle a buyer to cancel a pre-order that the Supplier still intends to fulfill, though Cluster will support communication with the Supplier regarding any significant delay.
3. Try Before You Buy
When you purchase a try-before-you-buy item, Cluster or the Supplier will authorize (but not immediately capture) your payment method before the order is fulfilled.
- Trial period. You will have a set trial period, disclosed at checkout or in your order confirmation, to decide whether to keep the item.
- Returning within the trial period. If you return the item in accordance with Cluster's Returns & Refunds Policy before the trial period ends, your payment method will not be charged the full amount (beyond any non-refundable fee disclosed at checkout, if applicable).
- Failure to return in time. If the trial period passes and the item has not been returned following the required return process, your payment method will be charged the full purchase price, and the sale will be treated as final, subject to Cluster's Returns & Refunds Policy.
- Item condition. Items returned under a try-before-you-buy arrangement must be returned in the condition specified by the Supplier's listing. Suppliers may deduct a restocking or condition-based fee, or decline the return, if the item is not returned as required.
4. General Terms Applicable to All Purchase Options
- Supplier discretion controls fulfillment. As with all products offered through the Services, the Supplier — not Cluster — determines fulfillment timing, inventory availability, and eligibility for cancellation, subject to the minimums described above.
- No liability for missed cancellation windows. Cluster is not responsible for a buyer's failure to cancel, modify, or return an order within the applicable window, including due to missed emails, spam filtering, or the buyer's own delay.
- Chargebacks. Buyers agree to contact support@theclusterhub.com to resolve any billing concern regarding a subscription, pre-order, or try-before-you-buy charge before initiating a chargeback or bank dispute, consistent with Section 5 of Cluster's Returns & Refunds Policy.
- Right to modify or discontinue purchase options. Cluster and its Suppliers reserve the right to modify, suspend, or discontinue any subscription, pre-order, or try-before-you-buy offering at any time, without liability, except as required by law with respect to amounts already paid for undelivered goods.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLUSTER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY SUBSCRIPTION, PRE-ORDER, OR TRY-BEFORE-YOU-BUY PURCHASE SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT OF FEES CLUSTER ITSELF RETAINED FROM THE RELEVANT TRANSACTION, OR (B) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT WILL CLUSTER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM A CANCELLATION, MISSED DEADLINE, OR CHARGE UNDER THIS POLICY. This section does not limit, and should be read together with, the disclaimers and limitation-of-liability provisions in Cluster's Terms of Service, Returns & Refunds Policy, and Shipping Policy.
6. Indemnification
The buyer agrees to indemnify, defend, and hold harmless Cluster, its officers, employees, and agents from and against any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from or related to the buyer's breach of this Policy, including any chargeback filed in violation of Section 4.
7. Governing Law
This Policy is governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles, without prejudice to any binding dispute-resolution or governing-law provision in Cluster's Terms of Service, which controls to the extent of any conflict.
